Primary Teacher Badalina Niyamo: Important decisions of the state government in the interest of teachers. Historical changes have been made in the Badalina Niyamo of state legislators, primary teachers and headteachers. Decisions touching more than two lakh teacher families were taken as per the direction of Chief Minister Shri Bhupendrabhai Patel.
Till now 40% of the vacancies in the district were given the benefit of district transfer to the teachers which will now be given the benefit of district transfer in 100% of the vacancies. The teachers who have been appointed on the condition of working in the same place, as per the direction of Chief Minister Shri Bhupendrabhai Patel, decisions have been taken touching more than two lakh teacher families.
Such teachers can apply for transfer even after five years. The spouses of government employees who are eligible for transfer from one district to another in the state can be deputed if they have a primary teacher or headteacher in a government school. From now on, the benefit of the espousal case will also be available in the case of subsidized institutions, public enterprises of the Gujarat government, government companies of central and state government. A grievance redressal committee was constituted for redressal of grievances in case of transfers.
State Education Minister Shri Jitubhai Waghani said that in order to maintain the interest of students’ education, the interest of teachers and the interest of the administration, the state government has taken important decisions regarding the Badalina Niyamo of legislators, primary teachers and headmasters which will benefit more than two lakh teachers.
Education Minister Shri Waghan added that ten years ago, rules were framed regarding the transfer of primary teachers. The Chief Minister of the state Shri Bhupendrabhai Patel has given guidelines to make important changes in the rules with full sympathy regarding the representations made by the primary education unions for change in these rules.
The Minister added that a fruitful meeting was held in stages with the President of Gujarat State Educational Association Shri Bhikhabhai Patel, President of Gujarat State Primary Teachers Union Shri Digvijay Singh Jadeja and other office bearers including Secretary of Education Department Shri Vinod Rao, Director of Primary Education Shri Mahesh Joshi. As a result of which these decisions have been taken. These decisions have been hailed by the unions as historic decisions.
Primary Teacher Badli Rules
- અત્યાર સુધી જે તે જિલ્લામાં ખાલી જગ્યાના ૪૦ ટકા શિક્ષકોને જિલ્લા ફેરબદલીનો લાભ અપાતો હતો જે હવે ૧૦૦ ટકા જગ્યા પર જિલ્લા ફેરબદલીનો લાભ આપવામાં આવશે.
- જિલ્લા ફેર અરસપરસ અને જિલ્લા આંતરિક અરસપરસ બદલીમાં સંબંધિત શિક્ષકોના વતન હોવા જરૂરી હતા તે જોગવાઇ દૂર કરવામાં આવી.
- ૧૦ વર્ષ એક જ જગ્યાએ નોકરી કરવાની શરતે જે શિક્ષકોને નિમણૂંક આપવામાં આવી છે
- તેવા શિક્ષકો પાંચ વર્ષ પછી પણ બદલી માટે અરજી કરી શકશે.
- જે સરકારી કર્મચારીઓ રાજ્યના એક જિલ્લામાંથી બીજા જિલ્લામાં બદલી પાત્ર છે તેવા કર્મચારીઓના પતિ કે પત્ની જો સરકારી શાળામાં પ્રાથમિક શિક્ષક કે મુખ્ય શિક્ષક હોય તો તેઓને પ્રતિનિયુક્તિથી મૂકી શકાશે.
- પતિપત્નીના કિસ્સાનો લાભ હવેથી અનુદાનિત સંસ્થાઓ, ગુજરાત સરકારના જાહેર સાહસો, કેન્દ્ર અને રાજ્ય સરકારની સરકારી કંપનીઓના કિસ્સામાં પણ મળવાપાત્ર થશે.
- બદલીઓના કિસ્સામાં ફરિયાદ નિવારણ માટે ફરિયાદ નિવારણ સમિતિની રચના કરાઇ.
Education Minister Shri Jitubhai Waghani while giving details of the historic amendments made in the Badalina Niyamo of Assistant, Primary Teacher and Head Teacher said that all the teachers who have been transferred so far could not be discharged due to vacancy of more than 10% establishment. It has been decided to dismiss the teachers as a special case. In a school where there is a school with zero teachers due to the dismissal of the transferred teachers, the last eligible teacher will have to resign only when a new teacher arrives. This decision will also apply to all teachers who have been replaced and not fired in the last three years.
Minister Waghani added that the Badalina Niyamo of primary teachers were fixed by the resolution dated 23/05/2012. New rules have been prepared by the state government, keeping in view the interest of recognized teacher’s associations as well as teachers. According to the new rules, 100 per cent of vacancies in the district will be given the benefit of district transfer instead of the 40 per cent vacancy in the district now.
The Minister said that in the district fair reciprocity and district internal reciprocal transfer, the provision that the teachers were required to have a hometown has been removed, i.e. the word hometown has been removed. In addition, after much deliberation with the teachers’ unions and their representatives, it has been decided that teachers who have relocated to another school may ask for two shifts if the original school wants to go to the original school if there is a vacancy in the original school.
The Minister further added that the teachers who have been appointed on the condition of working in one place for 10 years will be able to apply for District Transfer or District Aras Pars after five years. Not only that, the spouses of government employees who are eligible for transfer from one district to another in the state, if they have a primary teacher or headteacher in a government school, can be placed on deputation in the government employee transfer district.
Minister Waghani said that from now on, the benefit of the spouse’s case will be available in the case of grant-aided institutions, public enterprises of the Gujarat government, and government companies of Central and state governments. In addition, a grievance redressal committee has been constituted for redressal of grievances in case of transfers. That is, if there is any representation/complaint regarding the transfer, it can be submitted to the grievance redressal committee by the concerned teacher/headteacher and the grievance redressal committee will resolve it. So that teachers do not have to resort to unnecessary court cases.
